Terms and Conditions

1. Definitions

  • Mentastore: Located in Tilburg, the Netherlands, registered with the Chamber of Commerce under number 90300025.

  • Customer: The individual or entity purchasing products or services through Mentastore.

  • Consumer: A natural person acting outside a business or professional context.

  • Consigner: A trusted external seller or partner offering items via the Mentastore platform.

  • Parties: Mentastore and the Customer collectively.

  • Contact: support@mentastore.com or via the chat function on our website.

2. Applicability

These Terms apply to all offers, orders, agreements, and deliveries made by or on behalf of Mentastore, including those facilitated through consigners.
By placing an order, the Customer agrees to these Terms.
Deviations are valid only if confirmed in writing by Mentastore.

3. Offers and Prices

All prices are listed in euros (€), including VAT and excluding shipping costs unless otherwise stated.
Mentastore reserves the right to modify prices, offers, or product details at any time.
Obvious pricing or stock errors do not bind Mentastore.
If such an error occurs, Mentastore may cancel the order before shipment and refund the full amount.

4. Delivery Options

Mentastore offers two delivery options:

  1. 24-Hour Pre-Verified Delivery – Products available immediately from verified stock or trusted consigners.

  2. 1–10 Business Day Delivery (Backorder / In-Stock) – Products shipped first to Mentastore’s warehouse for authentication before being sent to the customer.

All products are verified for authenticity and condition before shipment.

5. Formation of the Agreement

The purchase agreement between Mentastore and the Customer becomes binding only once a shipping label has been created.
Until that point, Mentastore reserves the right to cancel or refuse an order in cases of:

  • Incorrect pricing, size, or stock information

  • Technical or system errors

  • Failure to verify authenticity

  • Payment irregularities or suspected fraud

If an order is canceled prior to shipment, the full payment will be refunded.

6. Payment

Payments must be completed using the available methods during checkout.
If payment fails, Mentastore reserves the right to cancel the order.
Late payments may result in statutory interest and collection fees.

7. Delivery and Risk

Orders are delivered to the address provided by the Customer.
Delivery times are indicative and not guaranteed.
Risk transfers to the Customer once the parcel has been delivered to the provided address or pickup location.
Mentastore is not liable for loss or theft after confirmed delivery.

8. Authenticity Verification

All items are verified for authenticity and quality.
If verification cannot be completed successfully, Mentastore reserves the right to cancel the order and issue a full refund.

9. Right of Withdrawal (Consumers Only)

Consumers have the right to withdraw from the purchase within 14 days after receiving their order, without stating a reason.
After notification, the product must be returned within 14 days.
Returned items must be unused, undamaged, and in original packaging.

Exclusions:

  • Customized or personalized items

  • Hygiene-sensitive products once unsealed

  • In-store purchases

Returns must be registered via https://www.mentastore.com/pages/return.
The Customer is responsible for return shipping costs unless otherwise agreed.

10. Notification of Delivery Issues and Product Defects

  • Packages not received must be reported to Mentastore within 14 days of the expected delivery date.

  • Product defects must be reported within 1 month of receipt, provided it can be shown that the defect existed upon delivery.

  • Reports must be sent to support@mentastore.com.

  • Returns must be registered through https://www.mentastore.com/pages/return.

11. Liability

Mentastore’s liability is limited to direct damages resulting from intent or gross negligence.
Indirect or consequential damages are excluded.
Maximum compensation will not exceed the value of the related order.

12. Force Majeure

Mentastore is not liable for delays or failures due to events beyond its control (such as natural disasters, strikes, or pandemics).
If such circumstances persist for more than 30 days, both parties may cancel the agreement without compensation.

13. Amendments

Mentastore may update these Terms at any time.
Significant changes will be communicated in advance.
Updated Terms apply only to new orders.

14. Governing Law

All agreements are governed by Dutch law.
